Terms of Service

1. Agreement Between Parties

This Terms of Service (“Agreement”) is between Newwave Communications (Africa) Pty Ltd Trading as: Newwave Africa (“ISP”) and you, the customer (“Customer”). This Agreement outlines the terms and conditions for your use of ISP’s internet service. By using the service, you agree to be bound by this Agreement.

2. Service Plan

You agree to subscribe to one of ISP’s available service plans. Each plan outlines specific details including internet speed, data allowances (if applicable), and pricing. You can find a full description of our service plans on our website or by contacting customer service.

3. Customer Use

You agree to use ISP’s service in accordance with all applicable laws and regulations. This includes, but is not limited to, refraining from illegal activity, copyright infringement, or any actions that may disrupt the service for other users. A full Acceptable Use Policy is available on our website.

4. Service Availability

ISP will use commercially reasonable efforts to provide a reliable and consistent internet service. However, ISP cannot guarantee uninterrupted or error-free service. Scheduled maintenance or unforeseen outages may occur.

5. Payment

You agree to pay all charges associated with your chosen service plan, including any applicable taxes or equipment rental fees. Payment is due on the date specified in your billing statement. Late payments may result in service suspension or termination.

6. Ownership

Unless otherwise specified in a written agreement, all equipment provided by ISP for your service remains the property of ISP. You are responsible for the safekeeping and proper use of the equipment.

7. Equipment Replacement

You are responsible for replacing lost, stolen, or damaged equipment provided by ISP, unless the damage is due to ISP’s negligence.

8. Term and Termination

This Agreement remains in effect for the term of your chosen service plan and automatically renews for subsequent terms unless terminated by either party with written notice. ISP may terminate this Agreement for any violation of its terms.

9. Limitation of Liability

ISP is not liable for any damages arising from your use of the service, including, but not limited to, lost data, business interruption, or consequential damages. ISP’s liability is limited to the total amount you have paid for service during the preceding month.

10. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of South Africa.

12. Modification of Terms

ISP reserves the right to modify the terms of this Agreement at any time. We will use reasonable efforts to notify you of any changes. Your continued use of the service after such notification constitutes your acceptance of the amended Agreement.
